1. Decree No. 65,563 of the State of São Paulo came into force on 12/03/2021, which institutes emergency measures aimed at tackling the COVID-19 pandemic, in line with state decrees nº 881, of 03/22/2020, nº 64.994, of 05/28/2020 and nº 65,545, of 03/03/2021. The basic commands contained are:

(1) Article 1 of Decree No. 65,545, which determines that “Extended, until 09 / April / 2021, the duration of the quarantine measure ” instituted by Decree nº 881.

(2) Article 2 of Decree No. 65,545, establishing that the territory of the Sao Paulo State, in its entirety, classified, exceptionally, in the red phase, in the days March 6 to 30, 2021.

(3) Decree No. 65,563 recommends that the opening and shift changes are adjusted in order to avoid the simultaneous displacement of employees, with the period between 7:00 am and 9:00 am for establishments  service providers.

(4) Article 4 of Decree No. 65,545 gave new wording to art. 3, of Decree 64.881, establishing that IT IS RECOMMENDED that the movement of people within the scope of the State of São Paulo (with permanent use of face protection masks, “limit yourself to the performance of essential activities ” in particular "between 20 hours and 5 hours ”.

(5) Decree nº 65.563 that implemented “emergency measures ” effective between March 15 and 30 of 2021, sealing the performance of administrative activities internal in person in commercial establishments and service providers non-essential services (art. 2, IV), religious activities and sporting events. In practice, item IV, of art. 2, of Decree 65,563 reinvigorates the provisions of item I, of Article 2, of Decree No. 64,881, of 03/22/2020.

It is essential to note that it DOES NOT APPLY to establishments whose object is ESSENTIAL ACTIVITIES, which comprise the activities listed in § 1, of article 3 of Federal Decree No. 10,282, of March 20, 2020, a rule that includes among the providers of essential services :

SERVICES RELATED TO INFORMATION TECHNOLOGY and data processing (data center) to support other activities provided for in this Decree; telecommunications and internet; call center service.

2. It is worth remembering that Decree nº 64.994, of 05/28/2020 of São Paulo instituted the “São Paulo Traffic News”Tackling the pandemic resulting from COVID-19, the entire content of which is available for access at the link:www.saopaulo.sp.gov.br/coronavirus/planosp.

3. The São Paulo Plan created specific sectorial protocols (Decree 64,994, art. 8, item II), which are of a “recommended ” and not of compulsory application. 4. ABES also recommends access to the entity's Portal and reading the booklet published by the Association. titled “HEALTH PROTOCOL OF THE ESSENTIAL SECTORS”.

5. ABES additionally indicates the consultation with the ABES SUPERVISOR - JUNE / 2020, entitled “COVID-19 TRANSMISSION PREVENTION AND CONTROL MEASURES IN THE WORK ENVIRONMENT ”.
