Softplan's SAJ Concilie solution is a new technological resource for agreements that can be carried out within the petition portal itself

The Amazonas Court of Justice (TJAM) adhered to a digital solution for mediation of the parties in the conciliation processes, so that the agreements are carried out within the petition portal itself and reduce the time for the definition of actions. Named SAJ Concilie, the technology was developed by Softplan, a technology company focused on Digital Transformation for Justice, and by Justto, a startup specializing in conciliation solutions.

TJAM is the first to use this technology in Brazil and inaugurates a new era in the role played by the Courts of Justice. “The new feature in e-SAJ (Softplan’s information management solution for Justice) will allow the parties to negotiate directly, through a channel provided by the Court, fostering less conflicting and more agile relationships”, argues Thiago Facundo, Director of Technology of TJAM Information.

Before technology, the Court that intermediated communication between the parties. Now, with the new feature, the agreement can be carried out within the petition portal itself, reducing the time for defining the process and eliminating procedural bureaucracy.

SAJ Concilie makes available in its system that the suggestions of the agreements are sent by e-mail and, with that, the proposal can be accepted, rejected or that it receives counterproposals, all in a digital way. The interactions between the parties involved are linked to the e-SAJ portal, which automatically records the movements of the process in the system.

“The use of conciliation through the e-SAJ portal will provide greater symmetry of information between the parties. And, even if there is no online agreement through the platform, the conciliation hearing tends to be faster and more effective, since the parties have already started the negotiation in advance”, explains Rodrigo Martins, product manager of Softplan's e-SAJ portal. .

Resource optimization

The new technology aims to relieve a number of costs for the Court related to the physical structure for holding hearings and the usual judicial procedures of a judicial unit. It will also reduce the time of analysis of the processes, publication routines, involvement of experts and citation of the parties (Post Office and Officials of Justice), among others.

“SAJ Concilie aims to improve even more the jurisdictional provision, bringing more agile resolutions of the processes, with lower expenses and in an assertive way to the citizens”, says Martins.

The solution meets the determination of the National Council of Justice (CNJ) to prioritize the conciliation of existing judicial processes in Brazil, with more agility. In 2018, according to the Justice in Numbers Report (CNJ), the conciliation rate in the State Courts was 11.5%, equivalent to more than 2.6 million cases in which the magistrate's decision simply approved an agreement between the parts.

Initially, the possibility of online conciliation will be enabled for a limited set of up to ten companies that receive large volumes of lawsuits related to the consumer area, such as telecommunications, banks, insurance companies and health plan operators.
