Jorge Sukarie considers a victory for the software sector

The government of São Paulo published yesterday (12) Decree 61,791, giving up temporarily charging ICMS on software acquired via electronic transfer, "until the place of occurrence of the triggering event is defined to determine the establishment responsible for paying the tax" .

In an interview with Jornal O Valor, Jorge Sukarie, president of ABES, highlights that ICMS should not be levied on any type of software, since the Federal Complementary Law 116, of 2003, includes software among those taxed by the ISS. "As a good portion of the sale is made by electronic transfer, it was a victory for the segment to be free of charge", he said.
