In April, the Federal Revenue published Normative Instruction 1,627/2016, which defines the rules for adhering to the Special Regime for Exchange and Tax Regularization (RERCT). The repatriation of capital deposited abroad without the tax authorities' knowledge may be carried out until October 31. The Repatriation Law was enacted in January this year. The topic will be addressed by lawyer and professor of criminal law Davi Tangerino at the ABES Software Conference, to be held on September 15, at WTC Events, in São Paulo, which will present an overview of the subject and clarify different issues.
 
“According to the rapporteur of the bill that created the amnesty, Brazilians would have between 400 and 600 billion reais undeclared abroad”, says Tangerino. “The amnesty allows Brazilians, provided that tax residents in Brazil on December 31, 2014, can have the crimes they committed to hide such assets forgiven, observing their lawful origin (inheritance, work, purchase and sale, etc.). Artistic works, jewelry, carpets and some other goods listed in the law cannot be regularized”. 
 
For the specialist, the biggest advantage is the forgiveness of crimes, in addition to allowing the effective enjoyment of these assets by their holders. “There are two risks that concern people the most: they may be disqualified and that the information shared there may be used against the taxpayer in an improper way”, he explains.
 
Partner of Trench, Rossi, Watanable Advogados, Davi Tangerino is a professor of Criminal Law at FGV/SP and UERJ and a PhD in Criminal Law from USP, with doctoral and post-doctoral internships in Germany. He was an advisor to the Minister of the Federal Supreme Court and a member of the National Council for Criminal and Penitentiary Policy (CNPCP).
