Pixeon – one of the largest healthcare technology companies – announces that its compliance program is 100% structured and its code of conduct disseminated among employees in all areas of the company. Called the “Integrity Program”, the platform was implemented by GRC Solutions, which guarantees the neutrality of processes, and complies with international standards of transparency. An Integrity Channel was also installed, a tool that allows anonymous reporting via the web, voice, answering machine or face-to-face assistance. Every complaint will be received by the GRC for investigation and action, but its authorship will be kept confidential, preserving the identity of the person who reported it.

For Armando Buchina, CEO of Pixeon, transparency as an absolute priority is present in Pixeon's culture, but it was important to consolidate a program capable of attesting to this procedure through recognized evidence. “In addition to experiencing transparency as one of our values practiced in the company, with the process and external audit in place, we are able to participate in public tenders and bids even in states with stricter legislation regarding compliance. This initiative not only reinforces our commitment to ethical principles, but also mitigates possible risks associated with deviations in internal conduct or in the relationship with customers and partners. ”, comments.

According to Marcelo Lapolla, a lawyer specializing in compliance, in the health sector, more than any other, this is a concern that makes perfect sense. “We have dozens of cases of misappropriation of resources and active corruption involving companies that provide services for the health area. What we observe at Pixeon, a commendable exception in the market, is the direct interest of the top management in maintaining transparency in all spheres of the company, this is very rare and positive in the sense of influencing the entire segment”, he evaluates.

Buchina and the other members of the Integrity Commission meet monthly to discuss improvements in this regard. GRC, the contracted company, was responsible for operating the Integrity Channel: which involves receiving, recording and managing information regarding reports of violations of Pixeon's Code of Conduct and Policies, sent by employees and third parties.

As Lapolla comments, corruption is in fact a serious crime that can be investigated, fought and even avoided by a well-structured compliance program, but the highest incidence of complaints involves cases of harassment, conflict of interest, relationship with competitors, among others. . “Often, especially at the beginning, the program may receive complaints whose most appropriate address would be to the HR department, which do not actually fall under the heading of crime, to be evaluated via the integrity channel. In this case, the complaints are forwarded to the responsible sector. In any case, it is always positive, because it helps in the process of educating and building the conscience of employees”, he adds.

The increasing demand around the need for a structured corporate compliance program is one of the most direct consequences of the anti-corruption law (nº 12,846, of 2013), which defined this item as a mitigating factor in case of discoveries of crimes of this nature. In Brazil, six states of the federation (Espírito Santo, Rio de Janeiro, Distrito Federal, Amazonas, Goiás and Rio Grande do Sul) have already passed state laws requiring proof of a compliance program or its tools as a condition for the company to be able to be hired to provide services to the public administration.
