Federal Deputy Orlando Silva, Directors appointed to the ANPD - Danilo Doneda and Fabrício da Mota Alves, and other authorities will participate in the ABES webinar, next Monday (13)

São Paulo, July 10, 2020 - The validity of articles 52 to 54 of the General Data Protection Law (Law 14.010 / 2020), referring to administrative sanctions, has been postponed to August 1, 2021. Despite this, many organizations, whether private, public or third party sector, will have difficulties to adapt to the new rules brought by the legislation. According to the ABES LGPD Index - a tool developed by ABES (Brazilian Association of Software Companies), in partnership with EY, 60% of companies still do not meet the requirements of the new law. In addition to the lack of adequacy, many managers still have doubts about points that involve the application of the new legislation and the form of inspection by the responsible body.

To discuss the challenges of the LPGPD and what will be the role of the National Data Protection Authority (ANPD), experts, representatives of the private sector and the government gather in a webinar promoted by ABES that will take place next Monday (13), at 15h. ABES invited Federal Deputy Orlando Silva to the event, who was the LGPD's rapporteur in the Chamber of Deputies, Deputy Deputy Chief of Economic Policy for the Civil House Marcos Cesar Pinto, Danilo Doneda and Fabrício da Mota Alves, nominated to the National Protection Council Data, the Executive Manager of Industrial Policy at CNI João Emílio Gonçalves and the Coordinator of the Regulatory Committee of ABES Andriei Gutierrez. The moderation will be by Thomaz Côrte Real, ABES legal consultant.

"The LGPD will provide security to the data subject, as it is legislation guided by principles, which must be respected when processing personal data. Data processing agents will have a great challenge in adapting measures of good practices and governance, and the National Data Protection Authority will have a fundamental role in the elaboration of guidelines, standards and guidelines, always observing the public interest and the demands of the economy and society driven by data ", reveals Thomaz Côrte Real, legal consultant ABES.

According to ABES Regulatory Committee Coordinator, Andriei Gutierrez, organizations will have a lot to do internally, reviewing and redefining policies and processes, especially with regard to security, data governance, privacy and transparency. "There is a lot of work to be done, ranging from the review of products, services, policies and processes to a serious re-discussion of business models appropriate to the new principles brought by the LGPD", he comments. Andriei also points out that "if, on the one hand, the principles have already been well defined by the Law, there is still a need for extensive regulatory and educational work to be done by the future ANPD so that organizations have the necessary framework for their compliance journeys".
