The INPI opened this Monday (5/12), the public consultation for the implementation of the new electronic system for requesting registration of computer programs, fully automated and with legal certainty. The purpose of the public consultation, published in the Official Gazette (DOU) today, is to provide transparency to the process and bring any suggestions from users, which will be evaluated.
 
Interested parties should fill out the electronic form with their suggestions and send it to saesp@inpi.gov.br by February 3rd. Users can download the form, as well as access the draft Normative Instruction and the User's Manual, on the patent public consultations page.
 
Among the main changes in the new system, it should be noted that the process will be completely electronic (via the internet), with simpler procedures, cost rationalization and faster publication of the registration certificate, which will take place within seven calendar days, if not there is an error in the order.
 
With the new system, based on an electronic form signed by a digital certificate, the user will be responsible for keeping the software for judicial proof, and the INPI will have a digital summary (Hash code) in its record, which can only be generated from the original source code. That is, if the software is modified after registration, it will generate a code different from the one the INPI has. Thus, the Hash guarantees legal certainty.
 
It should also be noted that there will be no more paper deposits after the implementation of the new system, under the responsibility of the Directorate of Patents, Computer Programs and Topographies of Integrated Circuits. Implementation is scheduled for the first half of 2017.
