Free and online tool allows organizations to check the level of adequacy to the new law before its effectiveness. The President of the Republic Jair Bolsonaro sanctioned Law 14.010 / 2020, which provides, among other topics, regarding the postponement of the effectiveness of articles 52 to 54 of the LGPD regarding administrative sanctions, which will come into force on August 1, 2021. Despite this postponement, many companies will have a lot of work ahead, according to data presented by the ABP LGPD Index, the result of a tool developed by ABES - Brazilian Association of Companies Software, in partnership with EY, which allows companies to diagnose their suitability for the new law.

Among the almost 1,000 Brazilian companies that have already carried out the diagnosis, 60% is still not in compliance with the requirements of the law. In the state of São Paulo, only 42% of the companies have already made adjustments to their policies and processes so as not to suffer sanctions. The LGPD ABES Index also shows that 30% has suffered some type of breach in the past 2 years and 76% deals with the collection of important data.

According to ABES president Rodolfo Fücher, being in compliance with the LGPD is a challenge for all areas of a company, human resources, sales, marketing, financial, administrative, and especially legal and IT, which need to ensure the existence of clear processes and adequate resources to prevent misuse of data and prevent information leaks and hacker attacks. "The indices are worrying, but ABES 'objective is not only to alert, but mainly to offer tools and references with the purpose of helping companies in their adaptation to the requirements of the LGPD", he comments.

The index also shows that, nationally, 65% of the technology segment are far from this compliance, 40% having already suffered breach incidents in the last 2 years and 80% of these enterprises work with the collection of confidential data.

According to EY's Cybersecurity partner, Marcos Sêmola, it is important to encourage the participation of companies to guide them, free of charge and in complete privacy, on how to comply with the law. “There is no more time to waste, organizations need to adapt as quickly as possible. With the Index, we were able to contribute to this process and offer a service to society fully connected to our business purpose, which is to build a better business world ”, he says.

ABP LGPD Index

ABES and EY created the online LGPD Diagnostic tool for companies that are in the process of adapting their LGPD processes to check their level of suitability for the project. The solution consists of a confidential questionnaire through which companies can self-assess the different points required by law. After filling in, the tool offers a diagnosis as to the degree of adequacy of the company with suggestions contextualized to the result.

To use the tool, it is neither necessary nor possible to send personal or company information, such as name, CPF / CNPJ, among others. After completing the questionnaire, the PDF report is available for download with information regarding the level of suitability and suggestions for improvement - it is not possible to access this document later. The data, sent anonymously, generates the LGPD ABES Index on the compliance scenario of Brazilian companies in relation to the new law.
