With a packed room and great interest from the participants, ABES promoted the lecture “General Data Protection Law (LGPD) - Impacts, Perspectives and Trends”, on February 5, in São Paulo, with a presentation by Bruno Bioni and Renato Leite Monteiro, founders of Data Privacy Brasil, partner in promoting this event. Lawyers, both professionals have been active in research and dissemination of knowledge about the impact of information technologies on privacy and protection of personal data, are engaged in the entire LGPD discussion process (Law 13,709 / 18), which had some articles changed by MP 870, signed by President Jair Bolsonaro.
 
Carolina Marzano, Coordinator of the Committees and Compliance Officer of ABES, welcomed the participants, highlighted the importance of the topic for companies and organizations in general and invited members to join the working group on data protection, whose next meeting will take place in March.

Francisco Camargo, executive chairman of ABES, said that he is concerned about the risk of the new law becoming a “barrier to entry” for small and medium-sized companies, considering that the sanctions in case of data leaks are heavy. “We will have to do data governance, which does not exist today. This is a long and complex discussion, ”he said.  
 
 
For Bruno Bioni, founder of Data Privacy Brasil and a member of the Latin American Network of Studies on Surveillance, Technology and Society (LAVITS), entrepreneurs should see that the LGPD offers a “window of opportunity” to organize data and bring more business value, by making an analogy with the benefits of putting order in the closet, throwing away what is no longer used, seeing better what you have. “With tidiness, the organization in the future will be worth more, so it is not just about cost. Homework needs to be done by 2020 ”, he emphasized. He further said that it is necessary to demystify the belief that the law is only for technology companies. “LGPD has a general impact on the economy, as it will involve all productive sectors, including clearer and tougher rules for the treatment of sensitive data, such as biometrics. The regulation also brings the concept of “anonymized data”. "The anonymization process, being done well, takes the weight off the regulation, by preventing the identification of people from the data collected and treated", he pondered.
 
“The central message is that adapting to the LGPD is a job that involves the entire company, from the board of directors to management, who will implement the actions, review the contracts, procedures, also considering professionals in the legal and legal areas. IT ”, says Renato Leite Monteiro, also founder of Data Privacy Brasil and PhD student in Philosophy of Law at the University of São Paulo (USP). He explained that the law brings several obligations for organizations, such as the production of impact reports on the collection and treatment of personal data, the adoption of information security standards, the use of privacy by design in projects and mandatory notification in case of information security incidents, which in Brazil are not few. “The penalties are considerably lower if the notification occurs. Any and all efforts to migrate risks and damages will be taken into account by the judges, in the event of an incident ”, he concluded.
 
Theme aroused great interest from associates 

Felipe Moreira, a lawyer at NC Games, approved the lecture and found the ideal format for the public, as it provided a broad and comprehensive overview of the LGPD. The executive believes that companies will have time to adapt to the rules.
