The new loan modality will be available from August

Suppliers from the federal government, states and municipalities may use the administrative contracts as collateral to make loans and financing in financial institutions that will be accredited by the Ministry of Economy.

THE Normative Instruction No. 53 published on July 9, in the Federal Official Gazette, establishes that the value of the credit operation cannot exceed 70% of the balance receivable from contracts selected by suppliers. The new loan modality should be available from August 17th, when the normative instruction comes into force.

According to the Secretary of Management at the Ministry of Economy, Cristiano Rocha Heckert, by August 17 the ministry will have completed the public call to carry out the accreditation of banks and fintechs (technology companies in the financial sector) and the platform where the operations will be done. “Over the past few months, we've had several conversations with financial institutions. The entire process was built with them. There was interest not only from large and medium-sized banks, but also from fintechs,” he said.

So far, companies that sell goods or provide services to the federal government receive payment after receipt of invoices, which proves the provision of the service or delivery of the good, which, under legal terms, can take up to 30 days counting from that certificate.

Prepayment of credit

When the new instruction comes into effect, these companies will be able to present the contract signed with the public administration to financial institutions and request the advance of the credit. For this to occur, the notices and respective administrative contracts signed must provide for the possibility of assignment of credits arising from the contract.

The bank will advance payment to the supplier at a discounted rate. When payment is made, the money will be sent by the government to the bank.

According to the secretary, the negotiation will be like an auction. The supplier will inform you that it has a contract and each accredited institution will be able to offer a fee. “It's a credit that tends to be cheap because it's guaranteed by the government,” Heckert said.

The financial institutions accredited and selected by the suppliers will receive payment through the supplier's escrow account. To have access to advance credit, the supplier will have to sign a bank domicile binding term. This account will be blocked for movement, in order to reduce the wealth of both public administration and accredited institutions.

According to the new standard, there is a transition rule for those contracts signed before the publication of the IN. In this case, the change in the contracts already signed must take place by entering into an addendum.

Annually, public purchases move, in the Federal Executive Branch alone, around R$ 48 billion. Adding the three powers and the three spheres of the federation, it is estimated that they reach around R$ 800 billion per year.

Small business

According to the president of Sebrae, Carlos Melles, the advance of credit is still little explored by small companies.

“The possibility of anticipating the 70% credit of the value of a contract signed with the public administration, in accredited financial institutions, should especially attract small businesses, which have little working capital. Sebrae is also working for the launch of a complementary platform that allows for the anticipation of invoice receivables. We believe that the two initiatives together will generate more competitiveness for this large market, which moves around R$ 800 billion a year in the three spheres of government.”

The secretary also highlighted that the anticipation of receiving resources can help micro and small businesses. "Considering the difficult scenario that the whole world is facing with this pandemic [from covid-19], these resources will be very welcome by many companies, especially micro and small ones that tend to have greater cash difficulties," he said.

Voluntary Transfers

The rules of the Normative Instruction can also be applied by states and municipalities in administrative contracts established with the use of resources from voluntary transfers from the Union. Shoppingnet). According to the secretary, there are currently 1,900 municipalities accredited on Comprasnet.

Credit Portal

A Credit Portal is being developed by the Federal Data Processing Service (Serpro). The platform will bring information about the contracts, and will make the connection between the supplier market, the Public Administration and the financial institutions.
