The high growth of online sales in Brazil is not news to anyone. Because of this, public authorities have also paid more attention to this area. An example of this is the new e-commerce law, enacted by President Michel Temer in December 2017, which sets out rules for disclosing the price of items and services sold over the internet.
 
So, if you have an online store, you need to review your website and avoid possible punishment or lawsuit from any customer. “The main rule of the new legislation is the mandatory price in all products and services disclosed by its virtual store”, explains the specialist in management software and executive director of ADV Tecnologia, José Claudio Brito.
 
The text, published in the “Official Gazette of the Union”, determines that traders must put its cash value next to the photo or description of the item sold on the internet. The characters must have a minimum body size of 12 and a legible font must be used.
 
The rules went into effect in December, but the federal government did not inform the time that companies have to adapt to the determinations. In addition, it did not explain what the possible punishments would be for online stores that do not comply.
 
“Shopkeepers need to be aware of both the rules already established in the Consumer Protection Code and the new rules of the December legislation. Thus, the entrepreneur avoids a future process on the part of the client”, advises Claudio.
 
The new e-commerce law is also a reinforcement of what was already foreseen in the Consumer Defense Code. An article in the document established rules for the dissemination of products in online stores.
 
What the code already determined
 
The Consumer Code determines some rules for sales in the e-commerce market. One of them is the obligation to disclose the total price of the product, including shipping, charges and taxes on the home page of the item being sold.
 
In addition to the rules regarding the value, the code defines that the merchant is responsible for the expenses in the case of exchanging the product. The consumer can also return the purchased item within 7 days and still get their money back.
