Entities from the business, academic, public and third sector sectors released this Thursday (14/06) a manifesto in defense of the creation of an authority for the protection of personal data in Brazil. The action takes place at a relevant time for the country, as the National Congress is advancing in the discussion of a general law that will regulate the matter to give legal guarantees to the privacy of citizens, the growing relevance of data for economic and social development being unquestionable. and the impacts of the entry into force of the General Data Protection Regulation (GDPR – General Data Protection Regulation) in the European Union, which took place on May 25, 2018.
 
“We have learned from international experience that the vast majority of countries that have general personal data protection laws have only managed to effectively enforce these laws to the extent that they have established a Personal Data Protection Authority or a Privacy Commissioner,” reads an excerpt. of the open letter.   
 
On the functioning of this authority, the manifesto advocates “the creation of a functionally independent Personal Data Protection Authority for Brazil. Given the importance of the topic, it is essential that there is no subordination of the regulatory body to the direct or indirect public administration. We also advise the creation of a multisectoral council composed of members from the public and private sectors, the third sector and academia for the purpose of advising and monitoring the activities of the regulatory entity”.

The document already has the signature of 34 entities, including the Brazilian Association of Software Companies (ABES) and the Public Ministry of the Federal District and Territories (MPDFT), and is open to adhesion by other institutions.
