The agreement is a spontaneous initiative of the trade associations to solve eventual problems in the segment, in an attitude of self-regulation

 

The National Association of Digital Certification (ANCD), the National Association of Digital Certification Authorities (ANCert) and the Association of Registration Authorities of Brazil (AARB) released in early March the terms of a common agreement, signed by the presidents of the three entities, whose objective is to promote joint actions in the sense of always seeking, in a consensual way, solutions for possible regulatory incidents within the scope of the Public Key Infrastructure - ICP-Brasil. “Our objective is to prevent certain issues from becoming, in an unnecessary way, formal complaints at the National Institute of Information Technology (ITI). In a consensual way, we understand that it is possible, through dialogue, to solve many problems with our associates, in an attitude of self-regulation of our industry”, explained Julio Cosentino, president of the ANCD.
 
At the meeting to formalize the agreement, it was also decided to create a commission with a representative of each entity for the analysis and preliminary solution of any incidents that are referred under this agreement. The representative of the ANCD will be the CEO of Soluti, Vinicius Sousa; by ANCert, the president of the entity, Rafael Caporali; and the AARB appointed its general director, Paulo Milliet Roque. Manuel Matos, chairman of the ANCD Council, highlighted that this initiative, taken spontaneously, is very positive for the market: “We are living in a new time and we have experience and maturity for understanding, in order to try to solve for ourselves issues that often end up crashing the systems and harming associates of the three entities”.
 
Nivaldo Cleto, president of AARB, understands that positive initiatives like these will always be welcome. “We will publicize this agreement among our associates. We really want it to bring the solutions we expect, as the segment as a whole is mature enough to do so. We therefore believe that it will be more effective to forward complaints to this tripartite commission, which will analyze and work with ICP-Brasil entities to quickly resolve the problem, giving the accused the right of defense, than forwarding them to the ITI or other responsible bodies. ”.
 
The document, called the Mutual Assistance and Cooperation Agreement, aims to describe the action of these entities in the treatment of possible regulatory incidents within the scope of the Public Key Infrastructure - ICP-Brasil and in the improvement of the normative set in order to guarantee the security and isonomy of the certification market and avoid asymmetries in light of the provisions of MP 2.200-2/2001.
 
For the president of ANCert, Rafael Piacentini Caporali, all decisions will be taken without any imposition, the solutions will always be put to the parties as a common suggestion of the three entities. “For each possible problem that arises, we will propose the solution considered most appropriate by the group”.
