Taxation GT promotes meeting in São Paulo

 

Recent changes in tax legislation were discussed at a meeting between ABES members, held on May 23, in São Paulo, promoted by the entity's Taxation Working Group, coordinated by André Iizuka and Fernando Arakaki. The broad agenda of the meeting addressed the evolution of the Tax Reform in the National Congress; Query Solution No. 3002/2017, which deals with the customizable Software and the rates that must be used to calculate the Assumed Income, Corporate Income Tax and Social Contribution on Net Income tax.
 
Participants were also able to discuss the recent ISS tax assessments of companies that sell software licenses; expectations regarding the STF judgment on the unconstitutionality of the Incra, Sebrae and Salário Educação tax bases and the Tax Regularization Program, established by MP nº 766/2017 and matter of the Law Conversion Project nº 10/2017.
 
In the current scenario of economic crisis and in the efforts of governments to increase tax collection, specialists in tax law point out that Brazil has increased legal uncertainty in this key area for planning and good business performance.
 
In view of these uncertainties, it is worth highlighting the movements of the IT sector, in which ABES is engaged together with other entities, to prevent Congress from overturning the veto of article No. 52/16 of the Draft Law to Reform Complementary Law No. 386/ 12, which provides for the ISS; in addition to the coordinated actions aimed at barring the approval of MP 774/2017, which deals with social security reimbursement and will represent a cost shock on companies, which will hardly be absorbed by the market, which may generate unemployment, reduce IT investments and paralyze the recovery of economic growth.
