The unconstitutionality of ICMS charging in SP on software transactions is on the agenda

Dr. Ricardo Godoi, from Godoi & Zambo Advogados Associados, is the special guest of the next meeting of the Tax Working Group, scheduled for August 20, from 3 pm to 5 pm. He will talk about the Taxation of Digital Goods - Judgment TJ 1015243-75.2018.8.26.0053, which declared the São Paulo Decree 63099/17, which required the payment of ICMS on software operations, to be unconstitutional.

The meeting has other topics on the agenda, including: the COSIT Divergence solution No. 2 – 2019, which deals with the non-incidence of PIS/COFINS on remittances abroad for software remuneration; the legal assessment on the exclusion of ICMS from the calculation of PIS and COFINS; and the Economic Freedom MP (881/2019) and its potential effects on labor legislation.
