Legal director presented proposals on the topics


In May, the legal director of ABES, Manoel Antônio dos Santos, attended two important public hearings on topics that impact the Brazilian software sector. The first took place on May 22, on the Complementary Law Project 366/2013 – Service Tax Reform (ISS), chaired by Deputy Guilherme Campos.
 
The director of ABES highlighted the conflicts that can occur when there are several municipalities involved in the provision of a service by a company (where it was provided, where the provider is from and where the service taker is from) and proposed changes in several paragraphs of the Law.
 
According to Santos, it would also be necessary to present a Constitutional Amendment Project (PEC), modifying articles 155 and 156 of the Constitution. The proposal is to remove communication services from the competence of the States, leaving taxes on goods, and to generalize the collection of taxes on all services, applying a list of exceptions.
 
The theme of the second public hearing took place on May 27. The director of the entity was at the Science and Technology, Communication and Informatics Commission to discuss the electronic and digital games sector in Brazil.
 
For the jurist, the audience opened the opportunity to share with those who prepare politics, Science and Technology and produce some projects in this area, some desires of the sector. The director of the entity presented the scenario of the game market in the country, highlighting the taxes that affect the sector and the losses caused by piracy. The executive also highlighted the reference of Brazilian legislation in relation to intellectual property.
