Sao Paulo, June 1, 2019 - Sanctioned in 2005, the "Lei do Bem" (Law 11.196) has the mission of promoting tax incentives for companies to invest in research and development of new technologies. Enterprises from different sectors can use this incentive, as long as they are taxed by the real profit, have tax profit in the base year of use and current Debt Negative Certificates. Within market competitiveness, this law allows companies to gain more highlights in the areas of research.

Especially during a pandemic, this law gains importance among the instruments to stimulate companies, especially for those who wish to invest in research on technological innovations. "The Lei do Bem brought opportunity and concessions in tax incentives so that enterprises can carry out research and develop new technologies. The growth of a nation needs investment in research, development and technology", comments Dr. Manoel dos Santos, legal director of ABES - Brazilian Association of Software Companies.

To discuss the topic, ABES, in partnership with ABGI - a consultancy specializing in tax incentives, development, processes, innovation management and financial management, brings together experts to analyze the impacts of legislation on global competitiveness and the challenges that the market will have to face. face during and after the pandemic. "It is important that companies are aware of this law and the way it operates, so that they can seek new business and outline new objectives in the market," explains Santos.

For the representative of ABGI consultancy, Pollyana Souza, "the Lei do Bem is one of the main financial mechanisms that has contributed to stimulating investment in RD&I projects in Brazil. Currently, the Lei do Bem presents itself as an important instrument support to companies in reducing the impacts of the pandemic: an alternative for reducing tax costs, maintaining the area of innovation and jobs. In this sense, it is extremely relevant for resuming the competitiveness of companies. "

"The main purpose of Lei do Bem is to foster innovation. However, in the almost 15 years since its edition, the scenario has changed. If today companies are innovating through open innovation with startups, it is natural that it is necessary to revisit the framework legal framework to reflect this new reality, allowing the Lei do Bem to fulfill its role of encouraging technological research in Brazil by investing in Investment Funds in Participations in the Capital Seed category (FIP - Capital Semente, under the terms of CVM Instruction nº 578/16) ", comments Franklin Lights, Vice President of Microsoft Participações.
