Daniella Caverni Machado and Francisco Eduardo Espuny are the coordinators 

ABES created a Working Group (WG) on the General Data Protection Law (Law No. 13,709 / 2018, better known as LGPD). The new WG aims to deepen the understanding of the law and promote debate on its impacts and challenges for the sector, as well as to discuss proposals regarding the future regulation of the LGPD.
 
Sanctioned in August 2018, the LGPD is expected to take effect from 2020, with the goals of ensuring the privacy of personal data and implementing clearer rules on the processes of collecting, storing and sharing this information. The law is applicable to all sectors of the economy and provides for high penalties, especially in the case of data leakage, with fines of up to 2% of billing (limited to R$ 50 million).
 
"In Brazil, we do not have a culture of analyzing the impact of government regulations broadly and in detail, and because LGDP is a very recent issue and an extremely complex problem, which impacts most Brazilian companies and most of them of the population, it is important to bring to light very important details that sometimes go unnoticed. Creating the WG will help to understand the law, identify the points to be clarified in the regulation and bring these issues, their implications, closer to technology professionals and an example of a Data Governance Program, according to the new law ", concludes Francisco Camargo, president of ABES.

Defined coordinators

 


In a meeting held on Tuesday (12), the coordinators of this WG were defined: Daniella Caverni Machado, from EFCAN Advogados, which represents the associate InterSystems do Brasil, and Francisco Eduardo Espuny, representative of the associate Matrix.

On the occasion, the coordinator of the Regulatory Committee, to which the Data Protection WG is linked, Andriei Gutierrez, presented the group with an update on the debate on LGPD in Brasilia.

The adviser to ABES Committees and Working Groups, Carolina Marzano, made a presentation of the objectives and expectations about the work of the WG, proposed the creation of subgroups and the definition of the annual meeting schedule.
 


In the end, the coordinator of the WG, Daniella Caverni, spoke about MP 869/18, edited by Jair Bolsonaro, who created the National Data Protection Authority and changed some clauses and deadlines of the LGPD (Law No. 13.709 / 2018). The meeting took place in São Paulo and brought together more than 50 participants.   

 
As part of the actions to foster this debate, the association is also promoting content dissemination events. Last February, he gave the lecture "General Data Protection Law (LGPD) - Impacts, Perspectives and Trends", with the participation of lawyers Bruno Bioni and Renato Leite Monteiro, founders of Data Privacy Brasil. Both work in research and dissemination of knowledge about the impact of information technologies on privacy and protection of personal data.
