Jorge Sukarie highlights the positive points in the text approved by the Chamber

  

The Chamber of Deputies approved this Tuesday, March 25, the Internet Civil Rights Framework (PL 2126/11, from the Executive), which establishes principles, guarantees, rights and duties for the use of the Internet in the country. The text will now go to the Senate for analysis, before going to the presidential sanction.
 
For ABES, some points stand out as victories for software companies and Brazilian society. According to Jorge Sukarie, president of the entity, the first point is to maintain the obligation to remove content that violates copyright without the need for a court order. “We would not be able to continue the agile fight against piracy, removing tens of thousands of sites and links with access to pirated software if we had to obtain a court order for each one of them. The damage to the sector would be enormous”, he says.
 
Another point highlighted by the leader was the exclusion of the article that required the installation of data centers in Brazil for companies that offer services to Brazilian citizens. "In addition to reducing competition, increasing costs, and not providing users with additional security, it would limit Brazilians' access to services that do not meet this requirement."
 
“ABES took an active part in the debates on this topic, during the course of the Marco Civil project in the Chamber, through visits to parliamentarians, letters signed jointly with other entities, in addition to the participation and manifestation of our legal director in a public hearing . Our objective has always been to guarantee a propitious environment for businesses in the software sector connected to the Internet”, he adds.

“Due to the unequivocal interest shown by the Federal Executive in approving this law, we believe that the PL will be approved in the Senate in April and sanctioned shortly thereafter by President Dilma, with little or no changes. However, several articles will require complementary laws for their application”, adds the legal director of ABES, Manoel Antônio dos Santos.
