Sustainability Diagnosis

Introduction

The Terms and Conditions described herein are intended to describe the practices that the Sustainability Diagnosis Tool (“Tool”) follows with regard to the privacy of information that is provided, processed and stored by the Tool.

Use and type of information processed by the Tool

When accessing the Tool, only data related to your company will be required, and no information that may identify the company or any type of personal data (ie, information related to an identified or identifiable natural person) of the user will be requested.

It is not the intention of the Tool to process personal data as well as sensitive personal data. Therefore, we ask that you do not enter personal data and sensitive personal data into the Tool before or during the survey. For the purposes of this Term, "Sensitive Personal Data" means personal data of an individual which consists of information about the data subject's racial or ethnic origin, his political opinions, his religious or philosophical beliefs, if he is a member of a union and its position to unions, its genetic data, biometric data, in order to uniquely identify a person, its physical or mental health or condition, its sex life and orientation, its criminal convictions and related infractions or security measures, its files of social Security.

We emphasize that the provision of information to us happens in an anonymous and non-identifiable manner, so that it will not be necessary to provide any company and/or personal information that may identify you for the use of the Tool.

To access the Tool, it is necessary to answer the initial questionnaire, in which the following information will be requested: (i) Company Size, (ii) Main Type of Customer, (iii) Number of Company Employees, (iv) Federative Unit in which the company operates and (v) Business Sector.

In order to ensure user anonymity, the Tool does not store any type of access data, so that if the user exits the survey before completing it, progress will be lost and it will be necessary to start the survey again in a new access .

The information provided by the user in the Tool may be used by us for research and statistical purposes, benchmarking and analysis of industry trends, without any identification of the user. Therefore, please make sure that you do not enter sensitive personal data or confidential information in the Tool if a free text field is present.

Tool Management

The entity that is acting as data controller, providing this Tool in which your information will be processed and stored is ABES – ASSOCIAÇÃO BRASILEIRA DAS EMPRESAS DE SOFTWARE, a national class entity, headquartered in São Paulo, State of São Paulo and which can act as a data controller in its own right.

Who can access the information?

ABES will only share the information provided by the user in the Tool with third parties who expressly agree in writing to provide an adequate level of privacy protection.

User information may be accessed in the Tool by the following categories of people for the purposes described below:

• Tool Administrators: Deploy and maintain the application with default settings, define templates and metadata, configure the question bank and branch logic that is usable by everyone.
• Survey authors: Create surveys, manage and control access to surveys and corresponding results, and create reports based on results.

data retention

ABES will retain survey response information stored in the Tool for seven (7) years in accordance with their respective records retention policies (or as enhanced/modified by regional and local policy requirements).

Safety

ABES has implemented accepted standards of technical measures and security policies that protect personal information in the Tool that has its control from unauthorized access, misuse or disclosure, unauthorized modification and unlawful accidental destruction or loss.

Recognition

Upon your electronic acceptance, the terms contained in these Terms and Conditions are deemed effective from the date of such acceptance and will remain in effect for up to 6 (six) weeks after the completion of the inquiry.
